Short answer: a copy of the deed of division (splitsingsakte) costs €19.85 as a PDF or €22.25 by post from the Dutch land registry, the Kadaster. Having it reviewed costs €49 (quick scan) or €249 (full report) with us. Amending the deed costs more: that always goes through a notary, who sets their own fee, plus €79 to register it with the Kadaster. According to Vereniging Eigen Huis, the Dutch homeowners' association, the costs of an amendment quickly run to several thousand euros.

Requesting
If the deed of division isn't among the seller's documents, you order a copy from the Kadaster. The division drawing comes with it. If the division was amended later, each amendment is a separate deed at the same tariff. How to order it is explained in Requesting the deed of division: how it works and what it costs.
Reviewing
A deed of division is a legal document of often dozens of pages, with regulations that refer to one of the notaries' model regulations and depart from it on some points. The notary handling the transfer makes sure the transfer is legally sound, but doesn't assess whether the rules suit your plans.
At ApartmentCheck you see for free, right after uploading, which documents are there and where the warning signs are. The quick scan (€49) lists the red flags, the full report (€249) goes through the deed and the other VvE documents topic by topic, with concrete advice. If the deed of division is missing, we request it for you with the full report at no extra cost.
Amending: how it works
Amending the deed of division is set out in Dutch law (articles 5:139 and 5:140 of the Civil Code):
- Decision. All owners cooperate, or the owners' meeting decides on the amendment with at least four fifths of the votes, unless the deed sets a different majority. The meeting must be called at least fifteen days in advance.
- Consent. Anyone holding a limited right on an apartment, such as the mortgage lender, must give consent.
- Notarial deed. The notary drafts the amending deed and executes it.
- Registration. The notary registers the deed with the Kadaster: €79 when submitted electronically. If the division drawing changes too, the Kadaster first sets a new complex designation, from €219.
Does an owner or mortgage lender refuse without reasonable grounds, or not respond? Then owners holding at least half of the votes together can ask the subdistrict court (kantonrechter) to replace that cooperation or consent. That costs extra time and money.
Why it can get expensive
The notary charges for the work, and an amendment is rarely just drafting one deed: the notary prepares the decision, collects the consent of every mortgage lender and sometimes adjusts the drawing. Notaries set their own fees, so always ask for a quote first. Vereniging Eigen Huis reports that the costs quickly run to several thousand euros, and that almost half of VvEs give up because of how complex the process is.
What this means for you as a buyer
- Read the minutes for planned amendments. Has the meeting already decided on an amendment, or is it on the agenda? Then as the new owner you pay your share, through your share (breukdeel) of the VvE's costs.
- Do you want something the deed doesn't allow? A roof extension, merging two apartments or changing the use often requires an amendment. Then count on the notary's fees, a four-fifths decision and the cooperation of every mortgage lender.
- An old deed can stand in the way of sustainability measures. According to Vereniging Eigen Huis, VvEs often get stuck on the deed of division over things like solar panels. So know what the deed allows before you make an offer.
